Virtual Event Terms and Conditions of Attendance and Participation

VIRTUAL EVENT TERMS AND CONDITIONS OF ATTENDANCE AND PARTICIPATION

By registering for and/or attending the Knit and Escape (“the Virtual Event”) provided by Ashworth Creative dba Knit and Escape (“the Organizer”), you agree to be bound by and comply with the following Terms and Conditions, which form a binding contract between you and the Organizer:

1. Participation
Your payment and registration entitle you to access to the Virtual Event for which you have registered. Any and all other costs associated with your attendance shall be borne solely by you, and the Organizer shall have no liability for such costs.

2. Content of the Virtual Event
The speakers, exhibitors, and sponsors at the Virtual Event are solely responsible for the content of their presentations, marketing, and/or advertising. You agree to hold the Organizer harmless from any losses sustained by you or harm caused to you resulting from that content. The views expressed by any event attendee, speaker, exhibitor, or sponsor are not necessarily those of the Organizer. During the Virtual Event, you may be invited to make contributions via text message/chat and the like. By making such a contribution, you hereby grant the Organizer an unrestricted, unlimited, irrevocable, perpetual, non-exclusive, transferable, royalty-free, fully-paid, worldwide right, and license to host, use, copy, reproduce, disclose, sell, resell, publish, broadcast, retitle, archive, store, cache, publicly perform, publicly display, reformat, translate, transmit, excerpt (in whole or in part), and distribute such contribution for any purpose. You acknowledge and agree that the Organizer, in its sole discretion, reserves the right to change any and all aspects of the Virtual Event, including but not limited to, the Virtual Event name, themes, content, program, speakers, performers, hosts, moderators, and time.

3. Prohibited Conduct
Use of obscene language and any other abusive or intolerant behavior is not allowed. You acknowledge and agree that the Organizer reserves the right to remove you from the Virtual Event if the Organizer, in its sole discretion, determines that your participation or behavior creates a disruption or hinders the Virtual Event or the enjoyment of the Virtual Event content by other attendees. Recording, live streaming, and videotaping is strictly prohibited. You may not record or broadcast audio or video of sessions at the Virtual Event without prior written permission from the Organizer. All Copyrights are reserved by the Organizer, speakers, exhibitors and sponsors, as the case may be.

4. Cancellation and Refund Policy
Tickets cancelled two weeks before the start of the Virtual Event will receive a full refund minus the transaction fees. No refunds will be provided for cancellations less than two weeks before the start of the Virtual Event. If you would like to transfer your class to another person please email us at knitandescape.virtual@gmail.com. Classes are transferable up to 48 hours before the event start date.

5. Use of Personal Information
The Organizer is committed to data privacy and protecting your personal information. Your personal information (e.g., name, address, email address, billing information, etc.) will be utilized to organize and administer the Virtual Event. In addition, the Organizer may use your personal information in the future to inform you about upcoming events that may be of interest to you. The Organizer will not disclose your personal information to any third party without your consent except where required to do so by law.

6. General
These Terms and Conditions shall be governed by and in accordance with the laws of the State of New York. Any legal action of whatever nature brought by you shall be commenced or prosecuted in the state and federal courts located in Dutchess County, New York If the Organizer is prevented from carrying out its obligations as it pertains to the Virtual Event you registered for as a result of any cause beyond its control, or such Virtual Event cannot be virtually conducted because of a software or issue with the hosting platform or due to acts of God, strikes, labor disputes, government requisitions, restrictions or war or apparent act of war, terrorism, disaster, civil disorder, epidemic or pandemic, curtailment or restriction on transportation facilities, or any other comparable calamity, casualty or condition (collectively a “Force Majeure”), the Organizer shall have the right to immediately terminate the affected Virtual Event without liability and shall be relieved of its obligations to you. If the affected Virtual Event is terminated due to a Force Majeure occurrence before the start of the Virtual Event, then the Organizer will reschedule the affected Virtual Event and your registration fee will be applied to the rescheduled Virtual Event.
